The City of Pleasant Hill Planning Commission will hold a public hearing to consider a recommendation to the City Council concerning a proposed zoning ordinance amendment to various sections of the Pleasant Hill Zoning Ordinance. The proposed amendment would affect the following areas of the Zoning Ordinance:
- Section 18.15.040, Commercial Use Classification
- Section 18.20.030 & Section 18.20.040.H, Development Regulations & Section 18.140.010 Definitions (Landscape)
- Section 18.20.040.I, and 18.25.140 Additional Development Regulations – Fences and Walls
- Section 18.20.050, Accessory Structures
- Section 18.20.095, Accessory Dwelling Units
- Schedule 18.25.020, Non-Residential Zoning Districts – Drive-Thru Facilities
- Section 18.50.020, Building Projections
- Section 18.50.100.B, Sight Obstructions
- Chapter 18.55, Off-Street Parking and Loading Regulations
- Chapter 18.60, Signs
- Section 18.65.030, Nonconforming Structures
- Section 18.85.010, Zoning Permits
- Section 18.125.050, Zoning Ordinance Amendments, Planning Commission action.
- Chapter 18.140, Definitions
- Other conforming amendments to the zoning ordinance for the topics listed above.
Pursuant to Section 15061(b)(3) of the Guidelines for the Implementation of the California Environmental Quality Act (CEQA) of 1970, as amended, the lead agency has determined that the proposed activity is exempt from CEQA. The City as the lead agency has determined with certainty that the proposed activity will not have a significant effect on the environment as the proposed amendments are intended to comply with applicable State provisions, streamline implementation and administration of the zoning ordinance, correct inconsistencies and clarify ambiguities. In addition, under California Public Resources Code section 21080.17, the California Environmental Quality Act (“CEQA”) does not apply to the adoption of an ordinance by a city or county implementing the provisions of section 65852.2 of the Government Code, which is California’s ADU law. Therefore, the portion of the ordinance related to ADU’s is statutorily exempt from CEQA because it implements the State’s ADU law
Please note that due to the State of California Governor’s Executive Order, the options for observing the Planning Commission meeting and for submitting communication regarding the meetings have changed. The Planning Commission will participate remotely via teleconferencing.
THE PUBLIC HEARING will be held by the Planning Commission starting at 6:30 p.m. on Tuesday, July 27, 2021. via Teleconferencing. More information on how to participate, including providing live comments during the meeting will be provided on the posted Planning Commission agenda.
